Waiver and Release By Parent/ Legal Guardian of Player (Minor) From Liability For South Bay Sports Training & Partners, including but not limited to Trosky Baseball & Kali Baseball

Parent/ Legal Guardian on behalf of Player (hereinafter referred to as “MINOR”) HEREBY WAIVE AND RELEASE, indemnify, hold harmless and forever discharge South Bay Sports Training and its partners, coaches, trainers, instructors, agents, teachers, trustees, employees, officers, directors, affiliates, successors and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I or MINOR ever had or may have, arising from or in any way related to MINOR’S participation in any of the events or activities conducted by, on the premises of, or for the benefit of,  South Bay Sports Training provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

I understand that the activities that said MINOR will participate in are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death.

MINOR has the necessary and requisite skills to participate in all facets of, and activities of and requested of this facility, except as noted below. The nature of the activities has been fully disclosed and any flyer, advertisement, or brochure relating to the participating activities is expressly made a part of this WAIVER AND RELEASE.

By this Waiver, I, on behalf of said MINOR, assume any risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with South Bay Sports Training, including but not limited to using the facility and its equipment in any manner, form or fashion, and practicing and/or engaging in any aerobic activity or action sports activities, events or other related activities on and off the premises.

MINOR is voluntarily participating in South Bay Sports Training programs, workouts, demonstrations, group screenings, performance training sessions at any of our locations.  If MINOR experiences any of the following during these activities inform Trainer immediately and discontinue activity:  convulsion, eye or muscle twitch, loss of awareness, involuntary movements, disorientation or dizziness.  If MINOR has had a Black-Out, Seizure, or Concussion of any sort, inform Trainer.  MINOR will not be eligible to participate in certain training activities (including the use of Vapor Strobes).

In the event of an emergency and in the event that I cannot be reached, I hereby give permission to South Bay Sports Training to secure emergency transportation, including hospitalization, at my expense, to any hospital, and to authorize treatment of MINOR.

I understand that if MINOR or PARENT/ LEGAL GUARDIAN fails to follow the conduct policy, uses inappropriate language or displays inappropriate behavior, as determined by South Bay Sports Training, MINOR OR PARENT/ LEGAL GUARDIAN may be dismissed from the lesson, camp, clinic or program permanently or temporarily, with no refund.

South Bay Sports Training uses pictures of minors participating in various activities in printed and online material, videos, and picture displays. On all marketing materials including but not limited to South Bay Sports Training websites and emails, including the use of any data and scores (baseline and improvements). By this Waiver, I, on behalf of said MINOR, grant South Bay Sports Training the right and permission to use pictures of MINOR or pictures in which MINOR may be included in conjunction with activities in photographs, videos, and printed and online material.

South Bay Sports Training does not assume responsibility for any lost or stolen personal property/ equipment.

This WAIVER AND RELEASE contains the entire agreement between the parties, and supersedes any prior written or oral agreements between them concerning the subject matter of this WAIVER AND RELEASE.

The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of, South Bay Sports Training whether by agreement, by operation of law, or otherwise.

Welcome To South Bay Sports Training

Visitors are welcome to visit during hours of operations. For your safety & security we have the following guidelines:

(a) Agree to follow the division rules before entry is permitted into the building.(b) All visitors must sign in and out through the main entrance lobby.(c) All visitors are required to read and acknowledge the Non-Disclosure and Waiver Agreement.(d) Smoking/tobacco use is prohibited in our facility. Please use designated outside areas.(e) Firearms/weapons are prohibited in our facility.(f) In the event of an emergency. Follow signage to the designated muster point.

During my visit to your facility, I will learn and/or have disclosed to me proprietary or confidential information (including, without limitations, information relating to technology, trade secrets, processes, materials, equipment, drawings, specifications, prototypes, and products) and may receive samples of products which not generally known to the public (hereinafter collectively called “Confidential Information”).

In consideration of your permission to visit your facility & for the courtesies extended to me during my visit:

1. I agree that I will not, without your written permission or that of your authorized representative, either;

(a) Disclose or otherwise make available to others any Confidential Information disclosed to me during this and any subsequent visit which (i) was not known to me or my organization prior to disclosure by you, or (ii) is not now or subsequently becomes a part of the public domain as a result of publication or otherwise; or(b) Use or assist others in using or further developing in any manner any confidential information.(c) Use cameras or video technology to disclose confidential information.

2. I also agree to conform to any applicable safety requirements, which are brought to my attention by any employee or by signs posted in the areas that I visit while on the premises, and to observe other reasonable safety precautions.

3. I also agree to South Bay Sports Training’s waiver and release by a parent/ legal guardian (self) of player (self). See below to review.

Travel Team Player/ Parent Contract

Players:-Respect teammates. -No swearing, negative body language, actions, or throwing any equipment (team and/ or personal) will be tolerated.-No cell phone usage (talk or text) during workouts, practices, and games.-Dress Code:look presentable on and off the field (Uniform: forward hats, belts, tucked/ buttoned jerseys, NO jewelry)-Understand that players will be responsible to know team signs and will be held accountable.-Hustle:sprint on and off field, run out everything, always look for the next play, and play until last out.-Hard Work:Players are expected to come to practices, workouts, and games ready to learn and work.-No use of drugs, alcohol, and tobacco.-No interaction with members in the stands (parents, fans, friends, etc.) during workouts, practices, and games.-Will be responsible to carry (no wheel bags) their equipment as well as team equipment.-Will be responsible to maintain their grades and will be asked to get grade checks filled out on time.Players & Parents:-Understand player & parent responsibilities and our expectations.-Understand that the player is the line of communication between parents and coaches.-Respect coaches and their decisions.-Understand that players are responsible to be on time and will be held accountable.-Understand that players are required to stay together during tournaments (in between games, team lunches, etc.).-Understand that players are responsible to have proper attire and equipment. -Will does not show any unsportsmanlike conduct toward the team, opponents, and especially umpires (on and off field).-Understand that there are no guarantees of playing time. We strive to balance playing time at players’ primary and secondary positions. At the next level, SS and 2B are considered Middle Infielders (MIF), they can and do play both positions when called upon. At the next level all 3 Outfield (OF) positions are considered OF. At the next level, outfielders can and do play all 3 OF positions when called upon. When a player enters a game in any way, this is considered playing time. This includes use as a pitcher, pinch runner, pinch hitter, designated hitter (DH), extra hitter (EH or XH), and/ or defense only. The dugout is a very important time where players have the opportunity to learn from their coaches and observe the game and its intricacies.-Respect fields, dugouts, and facilities. Players and Parents will be held responsible to leave places clean.-Understand that all logos (Trosky & Kali Baseball, Sensory Speed, South Bay Sports Training, and their sponsors/ partners) are the property of South Bay Sports Training. Please, no duplication of any sort is allowed.-Understand that if participating on any other teams or in other sports or activities we must know about them prior to committing to the team and know that if allowed all our team events, practices, and games, take priority.We also ask that if something arises during the season that limits a player’s full commitment (example: injuries, illness, personal situation, participating with other teams, sports or activities), we must be made aware of the situation.-Understand that it is against organization policies to write or post anything negative on social networking sites (Example: Facebook, Instagram, Twitter, etc…) or on message boards. This includes, but is not limited to conversations, topics, language, pictures, etc.-Understand that ANY team communication (including group texts/ emails) or team functions (meetings, team parties, bbq’s etc…) must be communicated to and approved by the organization. -Understand that we reserve the right to add, move, or remove players and coaches from team rosters before or during the current season. -Understand that schedules, dates, times, and locations are subject to change throughout the entire season. Players and parents are expected to make adjustments according to these changes. We will do our best to protect scheduled off weekends, but players and parents must be prepared to participate with the team any weekend during the season time frame.-Understand that we are not responsible for any lost or stolen personal property/ equipment.-Nutrition: understand that players are responsible to have enough water and food at workouts and tournaments. As athletes players should be eating and hydrating appropriately. -Injuries: understand that injuries are part of the game and players are responsible for preparing their bodies for workouts and games. Players must communicate how they feel and what they can and cannot do. Players need to take care of their bodies at home as well.If you are injured we do encourage you to attend any and all team workouts, tournaments, and team functions. We must be made aware of any and all injuries.-Agree to commit to the team for the entire duration of the season.-Uniforms & Team Equipment: understand that depending on season some uniform tops or team equipment may be issued to players and must be returned in a reasonable condition. Failure to do so will result in a $100 fee per uniform/equipment item.*We do recommend that you wash all uniform tops with cold water and air dry (team issued and personal).Parents:-Not allowed in or around dugout during workouts, practices, and games.-Give no coaching during workouts, practices, and games.-Give positive encouragement only during workouts, practices, and games (no swearing, negative body language, or actions).-Discussion Policy: there will be no discussing coaching issues such as playing time, batting line up, or positioning until the conclusion of the current tournament/ event. We are always more than willing to discuss issues regarding you or your players’ thoughts and feelings but need to wait until the entire tournament plays out before and discussions. -Behavior and conduct at any team events, tournaments, games, and practices will have to be professional (especially when wearing any South Bay Sports Training’s, Trosky Baseball’s or Kali Baseball’s and their partners/ sponsors logos), field complex’s and practice locations’ alcohol policies need to be respected. Any issues arising when there has been the use of alcohol will be magnified and less tolerable.-In order to keep our programs operating at the highest level (reserve spots in tournaments, order uniforms, and equipment, provide field and facility use, and provide quality training and instruction), it is essential that fees be paid on time.-Understand that there are no refunds on team fees for any reason (including but not limited to injuries and illness). Once you have committed to the team you have taken a roster spot that could have been offered to another player.-Understand that any payment plans are for convenience purposes only and at any time we reserve the right to charge the provided credit card in full for any remaining balances and/or fees. If the provided credit card is declined you will be responsible to provide a new card, cash, or check along with any fees. *We reserve the right, at our discretion, to change or modify all or some of these policies at any time. Failure to comply with any part of this contract by the parent and/or player can result in loss of playing time, suspension, or possible termination from the team, and all-season fees will be due in the full amount.

 

Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World HealthOrganization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illnesses and even death.[Name of Company] cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while utilizing [name of company]’s services or premises. It is not possible to prevent the presence of the disease. Therefore, if you choose to utilize [name of company]’ services and/or enter onto [name of company]’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize[name of company]’s services and enter [name of company]’s premises. These services are of such value to me[and/or to my children,] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize [name of company]’s services and premises in person [if applicable: “rather than arranging for an alternative method of enjoying the same services virtually (e.g. videoconference)].WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against[name of company] and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing [name of company]’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence, and give up any claim I may have to seek damages, whether known or unknown, foreseen, or unforeseen.
